The Demise of the 28-Article Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the announcement of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been stabilised. A American diplomat spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the grim essence of the outgoing year. By day, diplomatic battles are fought: positive announcements are released from various governments. Significant resources is expended on restraining particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "resolution".

Nocturnal Warfare

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is capable of detecting missile launches from enemy soil, a capability enabled by current data. From vantage locations, Ukrainian air force fighter jets that had been scrambled to engage hostile cruise missiles streaked across the sky – sophisticated military planes delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems engaged: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, most likely supplied through partner states. Every deployment creates sudden vibrations, shaking the windows. The brief panic quickly gives way to sober acceptance: perhaps the incoming missile won't hit its mark this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Soon after, a heavy machine gun fired at a aerial vehicle somewhere nearby, part of a rapid response unit – almost certainly Western-made equipment. Regrettably, the bullets missed the enemy aircraft – it maintained course toward its destination.

Intermittently, this carried on until dawn. Kyiv faced the morning news: seven people killed, damage and infrastructure problems in many homes as a result of the nocturnal offensive. As typically, everyone still continued their routines – living the war. But those 24 hours demonstrated Ukraine's critical military reliance on external assistance – a reliance that European nations are clearly incapable to replace in the near term.

Failed Diplomacy

The detailed framework from American leadership generated strong feelings, controversy and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new initiative from Washington adheres to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually win the battle. This pattern will, no doubt, endure.

Tactical Assessments

It is easy to blame specific actors of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. American leadership works based on a assumption understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The American government presumes that it is unfeasible to force Russia to relinquish the areas that it currently occupies in Ukraine's occupied territories.

The issue is that while recognising this factual reality, Washington does little to prevent Kremlin actions, through words or deeds, from believing that the situation will not change more in its benefit in the near future.

Opposing Positions

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its allies are coming close to fatigue. Their motivation to sign a deal that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to achieve ceasefire, but they will persist as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing lives and land but avoiding a entire defensive failure until conditions improve in its benefit.

Present Conditions

Objectively, there are no real preconditions for a ceasefire. Now, personal considerations are becoming relevant: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any plan Kyiv finds unsuitable, so that their focus does not switch to internal issues. And although their mission will now be much harder after current events, it remains highly unlikely that this will change their overall approach.

These opposing factors are guiding negotiations.

Conclusion and Outlook

It took a only one week to kill the 28 points of the current initiative. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all achieved their purpose.

While new initiatives based on previous concepts are forthcoming, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and show certain reluctance to change the course of events, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the foreseeable future, primarily depend on continued Western support.
